Were you outraged when an activist judge from San Francisco threw out over seven million votes cast in favor of California’s Proposition 8, which preserves traditional marriage?

And on February 7, 2012, the Ninth Circuit Court of Appeals panel ruled on our appeal and has stated that Prop 8 is unconstitutional.  We expected this outcome with a left-leaning Ninth Circuit, but we believe in the voter-backed Prop 8, and we plan to pursue this case further – to a larger Ninth Circuit panel, and then to the U.S. Supreme Court.

This threefold attack on marriage, democracy, and religious liberty has just begun and the stakes could not be any higher. Ultimately, the laws of 45 states that limit marriage to one man and one woman hinge upon this case. Our Nation has never seen such an attack on democratic principles!

The County of Imperial was the only governmental agency willing to defend Proposition 8 because Attorney General Jerry Brown, Governor Arnold Schwarzenegger, and the other governmental defendants refused to provide any defense or even appeal the trial courts decision. It was imperative that the County of Imperial was involved to assure the Ninth Circuit and U.S. Supreme Court would hear the case. Along with the “Yes on 8” campaign, we are vigorously defending your votes.

We agreed to represent the County of Imperial free of charge. Although the Campaign has been raising money to pay their attorneys, we must independently raise funds for our defense on behalf of the County.

On December 6, 2010, we presented our oral arguments to a three-judge panel at the Ninth Circuit Court of Appeals in San Francisco, CA.

In January 2011, the Court ruled that our client did not have proper standing in the case, but it left open the question of whether an elected county clerk would have sufficient standing.

At the same time, in January 2011, a new county clerk was elected to office in Imperial County.  Chuck Storey had been following our case, and he came to us and said he would be willing to defend Prop 8, as it has a direct impact on his day-to-day job.
